Applicant
The Applicant are a body of individuals from the claim group who have been duly elected by them to serve as their representatives for the Native Title claim and to manage its affairs. The Applicant have a number of roles in the claim:
Providing instructions to the group’s lawyers.
Keeping claimants informed on the current status of the claim
Assuring the claim is progressing and milestones being met
Section 62A of the Native Title Act provides that the applicant ‘may deal with all matters arising under this Act in relation to the application’.
Incidentally, the filing of a Native Title claim makes a group a Native Title party to an area under Queensland’s Aboriginal Cultural Heritage Act 2003, section 35(1) of which states ‘A native title party for an area is an Aboriginal party for the area.’ Under the Aboriginal Cultural Heritage Act, the Aboriginal Parties of an Area must be consulted when dealing with Aboriginal Cultural Heritage. To this, the Applicant also has a number of roles in Cultural Heritage:
Appointing and managing a service provider
Coordinating Cultural Heritage work
Liaising and negotiating Cultural Heritage Management Plans
Ongoing management of cultural heritage and knowledge databases
Ensuring compliance of land owners with the Act
